The Data Controller reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions. Such modifications may be made, through their websites, by any means admissible by law and will be mandatory during the time they are published on the website and until they are validly modified by subsequent ones. Delivery of prohibited products to minors

Such products may include, but are not limited to, alcoholic beverages. When placing an order for a product that is prohibited to minors, you must confirm that you are of legal age. Guarantees

All products offered on the website are covered by the commercial guarantee of the supplier of the website.

In the event of any lack of conformity at the time of delivery of the goods, the Data Controller will be liable to the customer for any faults that may arise within a period of three years from the date of delivery, which will be understood to have been made on the day that appears on the invoice or purchase receipt, or on the delivery note if this is later. In the absence of proof to the contrary, it shall be presumed that the lack of conformity that manifests itself in the two years following the delivery of the goods already existed when the goods were delivered.

On the other hand, the customer may demand from the Data Controller the correction of the lack of conformity, the reduction of the price or the termination of the contract.

In order for the goods to be brought into compliance, the customer may choose to repair or replace them, unless one of these two options is impossible or entails disproportionate costs for the employer. These measures shall meet the following requirements:

• They will be free of charge for the customer, including the expenses that are necessary for the goods to be brought into conformity, especially the costs of shipping, transportation, labor or materials;

• They shall be carried out within a reasonable period of time from the time when the employer has been informed of the lack of conformity and without major inconvenience to the employer.

The customer shall place the good at the disposal of the Controller, who shall recover it at the customer’s expense in a manner that causes the least inconvenience to the customer depending on the type of good.

You will not be liable for any payment for the normal use of the replaced goods during the period prior to their replacement.

The Responsible Party, on the other hand, will recover the goods at his/her expense, remove the non-compliant goods and, in the case of goods that have been installed, remove them and proceed to install the repaired or replaced goods, assuming the costs arising therefrom.

Likewise, the Data Controller shall provide the customer with documentary justification of the delivery of the goods by the customer, stating the date of delivery and the lack of conformity, as well as documentary justification of the delivery of the goods already in accordance with the customer, which must also include the date of such delivery and a description of the corrective action taken.

On the other hand, the customer may also demand a

Reduction in the price or the termination of the contract. The reduction in the price will be proportional to the difference between the value that the good would have had at the time of delivery if it had been in conformity, and the value that the good delivered has at the time of such delivery. The resolution will not proceed when the lack of conformity is of minor importance. The customer may opt for them as long as the following requirements are met:

  • When the measure to bring the goods into conformity proves impossible or disproportionate.
  • The Controller has not carried out the repair or replacement or has not carried out them correctly.
  • Any lack of conformity appears in the repaired or replaced good.
  • The lack of conformity is of such severity as to justify one of the two options.
  • The Controller has declared, or it appears from the circumstances, that it will not bring the goods into conformity within a reasonable time or without major inconvenience to the customer.

The Controller shall reimburse the customer as a result of the choice of this measure for the price paid for the goods upon receipt of the goods or, where appropriate, proof provided by the consumer that they have been returned.

The Client shall return the goods to the Controller, at the latter’s expense.

The Client may suspend the outstanding payment of the price until the Responsible Party fulfils its obligations. You may also request the rectification of the lack of conformity, the reduction of the price or the termination of the contract, if, as a result of the infringement of the rights of third parties, the use of the good is prevented or restricted.

Whether you are seeking the rectification of the lack of conformity, a reduction in the price or termination of the contract, you may claim damages if applicable.

Prices

All products indicate the selling price in Euros and include Value Added Tax (VAT).

If any other tax were applicable, this would be indicated.

Delivery and transport costs

The Data Controller ships in Spain and the Balearic Islands. In this regard, the Data Controller is aware of the application of the legislation in force in this country.

The associated applicable charges, including, but not limited to, shipping costs and service fees (the “Charges”), will be as stated in the application prior to the order being placed.

Methods of payment and execution of the service

By accepting these General Terms and Conditions, the cardholder certifies that he/she is aware of them.

When the amount of a purchase has been charged fraudulently or improperly using a payment card number, the holder may demand the immediate cancellation of the charge. In this case, the corresponding debit and repayment entries will be made in the accounts of the supplier and the holder as soon as possible.

However, if the purchase has actually been made by the cardholder and the demand for a refund is not the result of having exercised the right of withdrawal or resolution and, therefore, has unduly demanded the cancellation of the corresponding charge, the cardholder will be obliged to the Responsible Party to compensate for the damages caused as a result of said cancellation.

It allows payment in an immediate way. The customer must be previously registered in the Bizum Online Purchase Service.

The Data Controller undertakes to deliver the product within a maximum of 10 working days, starting from the day after the order is requested.

The availability of the products offered by the Data Controller may vary depending on the service. In the event of non-execution due to unavailability, the Data Controller will notify the customer by email as soon as it becomes aware of this situation. The period of this communication will not exceed in any case the maximum period of 30 days, the Responsible Party may give the Controller the double option of: offering the customer without a price increase, a service of similar characteristics or of higher quality, or unless justified and demonstrable reasons by the Responsible Party within this same period, to pay the sums paid for the cancelled service.

Right of withdrawal, refund of payment and claims

The customer will have a minimum period of fourteen calendar days to withdraw, from the day of receipt of the product, without any penalty and without indicating the reasons.

The customer will receive the full amount of the purchase, i.e. the price of the product plus shipping costs within 14 calendar days from the date on which he or she has been informed of the consumer’s decision to withdraw from the contract using the same means of payment used by the consumer for the initial transaction. unless otherwise expressly provided by the consumer and provided that the consumer does not incur any costs as a result of the refund.

On the other hand, the exercise of this right is not subject to any formality, so the consumer is required to return the product in perfect condition without limiting the use of the product (as long as it does not go beyond the mere verification of its good condition and operation).

In accordance with the provisions of Article 103 of Law 3/2014, of March 27, 2014, amending the revised text of the General Law for the Defense of Consumers and Users, supplies of services or goods made in accordance with the consumer’s specifications or clearly personalized, or which, due to their nature, cannot be returned or may deteriorate or expire quickly, They are exempt from withdrawal.

Return in withdrawal period

Regardless of the right of withdrawal described above, our return policy allows the product to be returned up to 14 days from the date of receipt of the product. The foregoing does not extend to perishable products, for such products please contact customer service at the email info@eecgg.com, and in any case within a maximum period of fourteen calendar days from the date on which the right of withdrawal from the contract is formalized. The deadline will be deemed to have expired if the customer returns the product before the end of the period. The customer will be responsible for the costs of returning the product.

The products must be returned in the same condition in which they were delivered, therefore, the new products must be returned new, unused and complete, however, if it is not returned in the same original packaging the good may suffer depreciation. Therefore, in order to avoid transport problems, please ensure that the package is properly protected and sealed. Once received, we will check your status. As soon as we check that the item(s), as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid.

Note: Information about the extended return window: For the 2023 holiday season, most products purchased between December 1 and December 31 can be returned up to December 1.

Refund of payment

The reimbursement of the amounts received by the client will be made using the same means of payment used by the client, unless otherwise stipulated.

The Responsible Party may withhold the refund until the product has been received, a reason for withdrawal, or until the customer provides proof of return of the product, depending on which condition is met first.

Return of the defective product.

In the event that the product is not in good condition and the causes attributable to it are not the customer’s fault, the customer will have the right to return the product, informing the Responsible Party of the reason for return through any of the means provided in these terms and conditions, and at no cost to the customer. Any return due to defect or poor condition of the product will not be considered a right of withdrawal.

The Data Controller undertakes to bear the cost of the return and to return the product for a new one in accordance with the conditions accepted at the time of sale.

Jurisdiction

Likewise, the Data Controller reserves the right to file any civil or criminal actions it deems appropriate for the improper use of its website and contents or for the breach of these conditions.

The relationship between the user and the provider will be governed by the regulations in force and applicable in the Spanish territory. If any dispute arises, the parties may submit their disputes to arbitration or resort to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard.
